Terms of Service

By creating an account, accessing, or using MenuQR (“the Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service.

These terms apply to all users of the Service, including restaurant owners, managers, and any other individuals who access the platform.

MenuQR is a digital menu platform that allows restaurant owners to create, manage, and share QR-code-accessible digital menus. Our Service includes:

• Creation and management of digital menus with categories and items
• QR code generation for table and venue use
• AI-powered menu item description generation
• Analytics and scan tracking
• WhatsApp order integration
• Multi-language support (English, Urdu, Arabic)

To use MenuQR, you must create an account with a valid email address. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security and confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. By registering, you represent that you meet this age requirement.

You agree to use MenuQR only for lawful purposes. You may not:

• Upload, post, or share any content that is illegal, harmful, defamatory, or misleading
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to send unsolicited communications (spam)
• Scrape, copy, or redistribute content from the Service without permission
• Use automated tools to access the Service in a way that places unreasonable load on our servers
• Engage in any activity that interferes with or disrupts the Service
• Upload menu content that is inaccurate or untruthful — you are responsible for the accuracy of all prices, item names, and descriptions displayed on your public menu
• Misuse the AI description feature to generate harmful, offensive, or misleading food descriptions

Your content: You retain ownership of all content you upload to MenuQR, including menu items, descriptions, images, and restaurant information. By uploading content, you grant MenuQR a non-exclusive, royalty-free, worldwide license to display, store, and transmit that content solely to operate and improve the Service.

Our content: MenuQR and its licensors own all rights to the platform, software, design, logos, and trademarks. You may not copy, modify, distribute, or create derivative works from our content without written permission.

MenuQR offers a free plan and paid subscription plans. By subscribing to a paid plan:

• You authorize us to charge your payment method on a recurring basis
• Subscription fees are billed monthly or annually, as selected
• All fees are in US dollars unless otherwise stated
• You may cancel your subscription at any time from your billing settings
• Cancellation takes effect at the end of the current billing period
• We do not provide refunds for partial billing periods, except as required by law

We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Paid plans may include a 14-day free trial. You will not be charged during the trial period. After the trial ends, your subscription will automatically convert to a paid subscription unless you cancel before the trial period expires.

Free Plan: No charges apply. No refunds needed.

Paid Subscriptions:

We want you to be completely satisfied with MenuQR.

• 14-day free trial: All paid plans include a 14-day free trial. You will not be charged during this period. Cancel any time before the trial ends and you will not be billed.
• Monthly subscriptions: We do not offer refunds for partial months. If you cancel, your subscription remains active until the end of the current billing period, after which you will be downgraded to the free plan.
• Annual subscriptions: If you subscribed annually and are not satisfied, contact us within 7 days of your annual renewal date at hello@getmenuqr.com and we will review your request on a case-by-case basis.
• Exceptional circumstances: If you experience a significant technical issue caused by MenuQR that prevents you from using the Service for more than 72 consecutive hours, you may request a prorated credit. Contact us at hello@getmenuqr.com with details.
• Chargebacks: If you initiate a chargeback with your bank without contacting us first, we reserve the right to immediately suspend your account.

For all refund requests, email hello@getmenuqr.com with your account email and reason. We respond within 3 business days.

This refund policy does not affect any statutory rights you may have under applicable law.

You may terminate your account at any time by contacting us or using the account deletion option in your settings. We may suspend or terminate your account if:

• You violate these Terms of Service
• We are required to do so by law
• Your account is inactive for an extended period (12+ months on a free plan)
• We discontinue the Service

Upon termination, your right to use the Service ceases immediately. We may delete your data 30 days after account termination, except where retention is required by law.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

To the maximum extent permitted by applicable law, MenuQR shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to the Service shall not exceed the greater of (a) $100 or (b) the amount you paid to MenuQR in the 12 months preceding the claim.

You agree to indemnify and hold harmless MenuQR, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

MenuQR integrates with third-party services including Stripe (payments), Supabase (database), OpenAI (AI features), and WhatsApp. Your use of these integrations is also subject to those third parties' terms and privacy policies. We are not responsible for third-party services.

These Terms of Service are governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law principles.

For users located in the UAE or other jurisdictions, local consumer protection laws may also apply.

Dispute Resolution: We encourage resolving any disputes through direct communication first. Please email us at hello@getmenuqr.com — most issues can be resolved within 48 hours.

If a dispute cannot be resolved informally within 30 days, either party may pursue their legal remedies through the courts of competent jurisdiction in Lahore, Pakistan.

Nothing in this section prevents you from seeking emergency injunctive relief in any jurisdiction where you have legal rights to do so.

We may update these Terms from time to time. When we make material changes, we will notify you by email or by displaying a prominent notice on the Service. Your continued use of MenuQR after the effective date of revised Terms constitutes your acceptance of those changes.
